Top Q: What is this litigation about?

A:

In 2009, a class action was commenced in the Ontario Superior Court of Justice  against Bear Lake Gold and certain of its current or former officers and directors. By order issued on August 10, 2010, the Court certified the class action and approved the Settlement Agreement reached between the parties to the class action on May 12, 2010.  The Settlement is a compromise of disputed claims and is not an admission of liability, wrongdoing or fault on the part of any of the Defendants, all of whom have denied, and continue to deny, the allegations against them.

Top Q: How do I know if I am a Class Member?

A:

Included in the Class are all individuals and entities who purchased common stock of Bear Lake Gold Ltd, formerly known as NFX Gold, Inc. and traded on the TSX-V during the period from July 18, 2006 to and including July 17, 2009 and who held some or all of those shares when trading in Bear Lake Gold’s common stock was halted on July 17, 2009.

Excluded from this class are the Defendants; Bear Lake Gold’s past or present subsidiaries, affiliates, officers, directors, legal representatives, heirs, predecessors, successors and assigns; any member of the Defendants' families; and any entity in which any of them has or had a legal or de facto controlling interest.

Top Q: Why is this case a Class Action?

A:

In a class action, one or more people, called Class Representatives sue on behalf of all people who have similar claims.  In this case, the Class Representative is Gary Henault.  All of the people who were similarly treated are known as a Class, or as Class Members.  One court resolves all issues for the Class, and protects the interest of Class Members while preserving court resources.

Top Q: What does the settlement provide?

A:

The Settlement creates a fund in the amount of $1,305,000.00 plus interest.  Your actual recovery will depend on a number of factors, such as, among other things, the number of shares purchased or sold, the timing of your transactions, expense of administering the claims process and lawyers' fees and expenses awarded, as well as the number of eligible shares purchased by class members who elect to participate in the claims process.

Top Q: Should I get my own lawyer?

A:

You do not need to retain your own lawyer because Class Counsel is acting on behalf of the entire Class.  If you wish to retain your own lawyer, you may do so at your own expense.
